Collection of Information
We collect information you provide directly to us, such as when you create or modify your account, request services, contact customer support, or otherwise communicate with us. If you choose to provide us with personal information, you consent to the transfer and storage of that information to our servers located in the United States or elsewhere. We may collect and store any personal information you may share with us, like:
•email address, password, physical contact information, delivery notes, payment method;
•correspondence through the App to us or a Chore Hero;
•computer sign-on data, statistics on page views, traffic to and from the App, and ad data;
•other information, including IP address and standard web log information, and supplemental information from third parties;
•usage statistics. Information We Collect Through Your Use of Our Services When you use our Services, we collect information about you in the following general categories:
When you use the Services, we collect location data about the jobs from the Company app used by the Chore Hero. If you permit the Company app to access location services through the permission system used by your mobile operating system (“platform”), we may also collect the location of your device when the app is running in the foreground or background. We may also derive your approximate location from your IP address. Transaction Information: We collect transaction details related to your use of our Services, including the type of service requested, date and time the service was. provided, amount charged, and other related transaction details. Additionally, if someone uses your promo code, we may associate your name with that person.
Usage and Preference Information
We may collect information about your mobile device, including, for example, the hardware model, operating system and version, software and file names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.
Call and SMS Data
Our Services facilitate communications between users and Chore Hero(s). In connection with facilitating this service, we receive call data, including the date and time of the call or SMS message, the parties’ phone numbers, and the content of the SMS message.
When you interact with our Services, we collect server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service you were using before interacting with our Services.
We don't sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We do, however, use third-parties for website functionality, analytics, and social sharing. If you are a registered user of Facebook or Twitter, for example, our site enables your use of certain Facebook and Twitter sharing features. Social network widgets, however, may collect your social network “browser”cookies, regardless of whether you use social sharing widgets. If you are a member of social networks, you should consult the respective social networks’ privacy disclosures for more information about how they collect and share information. We also use other sharing widgets, which may collect and share data with interest-based advertisers. Use Our primary purpose in collecting personal information is to provide you with a safe, smooth, and efficient experience. We also use the information we receive about you in connection with the Services of this website, other users, members, and advertisers that purchase ads on this site.
For example, we may use the information we receive from you to:
•provide the services and customer support you request;
•resolve disputes, collect fees, and troubleshoot problems;
•prevent potentially prohibited or illegal activities, and enforce the Terms;
•customize, measure, and improve our Services and the Apps' content and layout;
•tell you about targeted marketing, service updates, and promotional offers based on your communication preferences; and compare information for accuracy, and verify it with third parties.
Terms of Service
The App is a web-based communications platform which enables the connection between Clients and Workers. “Clients” are individuals and/or businesses seeking to obtain on-demand, hourly services (“Jobs”) from Workers and are therefore clients of Workers; and, “Workers” are individuals and/or businesses seeking to perform Jobs for Clients. Clients and Workers together are hereinafter referred to as “Users.” If you agree on the terms of a Job with another User, you and such other User form a Service Agreement directly between the two of you as set forth in more detail herein. Company is Only a Venue. Company acts as a venue for Users to view and post requests for Jobs, and enable connections between Users for the fulfillment of Jobs. The Company is not a party to any actual agreement or transaction between Clients and Workers even though Company may from time to time provide tools that relate to scheduling, such as a tool to enable a Client to enter into a transaction to obtain services directly from a Chore and payment services to facilitate the transaction. As a result, Company has no control over the accuracy or correctness of the content or information provided or used by such Clients or Workers, including the the quality, timing, legality, failure to provide, or any other aspect whatsoever of Jobs, Workers, Clients; nor of the integrity, responsibility, qualifications or any of the actions or omissions whatsoever of any Users. Company makes no representations about the suitability, reliability, timeliness, or accuracy of the Jobs requested and services provided by Users identified through the App whether in public, private, or offline interactions.
You acknowledge and agree that a contract (the “Service Agreement”) is formed when you agree on the terms of a Job with another User. The terms of the Service Agreement include the terms set forth in this Section, the engagement terms proposed and accepted on the App, and any other contractual terms accepted by both the Chore and their Client to the extent such terms do not conflict with the terms in this Agreement including this Section and do not expand Company’s obligations or restrict Company’s rights under this Agreement. You agree that Company is not a party to any Service Agreement and the formation of a Service Agreement will not, under any circumstance, create an employment or other service relationship between Company and the Worker. Release. Workers ARE INDEPENDENT CONTRACTORS AND NOT EMPLOYEES OF COMPANY. COMPANY DOES NOT PERFORM JOBS AND DOES NOT EMPLOY INDIVIDUALS TO PERFORM JOBS. USERS HEREBY ACKNOWLEDGE THAT COMPANY DOES NOT SUPERVISE, DIRECT, CONTROL OR MONITOR A Worker’S WORK AND IS NOT RESPONSIBLE FOR THE WORK PERFORMED OR THE JOBS IN ANY MANNER. YOU HEREBY RELEASE AND HOLD COMPANY AND ITS DIRECTORS, OFFICERS, AGENTS AND EMPLOYEES HARMLESS FROM ANY CLAIMS, COSTS, DEMANDS AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE INCLUDING WITHOUT LIMITATION REASONABLE ATTORNEYS' FEES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH DISPUTE.
Your Use of Services User Accounts
In order to use most aspects of the Services, you must register for and maintain an active personal user Services account with Company ("Account"). You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18), to obtain an Account. Account registration requires you to submit to Company certain personal information, such as your name, address, mobile phone number and age, as well as at least one valid payment method supported by Company. You agree to maintain accurate, complete, and up-to-date information in your Account. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access or use the Services. Please keep in mind that we will treat anyone who uses your user name and password as "you," and that you are responsible for all activity that occurs under your Account. You agree to maintain the security and secrecy of your Account username and password at all times. However, if you do give someone your username and password, or if you fail to adequately safeguard such information, you are responsible for any and all transactions that the person performs while using your Account or your email account, even those transactions that are fraudulent or that you did not intend or want performed. You are responsible for notifying the Company immediately if you suspect that someone is using your username and/or password or otherwise obtaining access to the Services in this or any other inappropriate manner. Unless otherwise permitted by Company in writing, you may only possess one Account.
Network Access and Devices
You are responsible for obtaining the data network access necessary to use the Services. Your mobile network's data and messaging rates and fees may apply if you access or use the Services from your device. You are responsible for acquiring and updating compatible hardware or devices necessary to access and use the Services and Applications and any updates thereto. Company does not guarantee that the Services, or any portion thereof, will function on any particular hardware or devices. In addition, the Services may be subject to malfunctions and delays inherent in the use of the Internet and electronic communications.
Conditions of Use
As a condition of your use of our Services, you expressly represent and warrant that (i) Users possess the legal authority to create a binding legal obligation; (ii) Users will use the App in accordance with the Terms; (iii) Users will only use the App to post, request or view, as applicable, available Jobs for you or for another person for whom you are legally authorized to act with other Users; (iv) you will inform such other persons about the terms and conditions that apply to the Job you have made on their behalf, including all laws, regulations, rules and restrictions applicable thereto; (v) if User is scheduling a Job on behalf of another person, you are individually responsible for ensuring that such other person is a party to the separate agreement for the Job; (vi) all information supplied by User to Company is true, accurate, current and complete, and (vii) User will safeguard his or her Account information. You may not authorize others to use your Account, and you may not assign or otherwise transfer your Account to any other person or entity. Company retains the right, in its sole discretion, to deny access to the Services to anyone at any time and for any reason, including, but not limited to, for violation of the Terms. You agree that you will only use the Services for lawful purposes.
Establishing Payment Account
All Charges and payments will be enabled by Company using the preferred payment method designated in your Account, after which you will receive a receipt by email. If your primary Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that Company may use a secondary payment method in your Account, if available. By providing your credit card information to us, you agree that we are authorized to charge your card with the total cost of the service and any required deposit. Charges paid by you are final and non-refundable, unless otherwise determined by Company. As between you and Company, Company reserves the right to establish, remove and/or revise Charges for any or all services or goods obtained through the use of the Services at any time in Company's sole discretion. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand. Company will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof. Company may from time to time provide certain users with promotional offers and discounts that may result in different amounts charged for the same or similar services or goods obtained through the use of the Services, and you agree that such promotional offers and discounts, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you. You may elect to cancel your request for Services at any time prior to the commencement of such Services, in which case you may be charged a cancellation fee on a Worker’s behalf.
In Company’s sole discretion, Users may be subject to an extensive vetting process before they can register for and during their use of the App, including but not limited to a verification of identity and a comprehensive criminal background check, at the Country, State and local level, using third party services as appropriate. Users hereby give consent to Company to conduct background checks as often as required in compliance with federal and state laws, including, without limitation, the Fair Credit Reporting Act. Although Company may perform background checks of Users, as outlined above, Company is not required to do so and cannot confirm that each User is who they claim to be and therefore, Company cannot and does not assume any responsibility for the accuracy or reliability of identity or background check information or any information provided through the App. When interacting with other Users, you should exercise caution and common sense to protect your personal safety and property, just as you would when interacting with other persons whom you don’t know. NEITHER COMPANY NOR ITS AFFILIATES OR LICENSORS IS RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE APP AND YOU HEREBY RELEASE COMPANY AND ITS AFFILIATES OR LICENSORS FROM ANY LIABILITY RELATED THERETO. COMPANY AND ITS AFFILIATES AND LICENSORS WILL NOT BE LIABLE FOR ANY CLAIM, INJURY OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF THE APP. Exclusion of Warranties
